Encore Live Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Encore Live mobile application and related services (the "Service"). The Service is provided by Encore Live ("Encore Live", "we", "us"). By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
2. Accounts
You are responsible for safeguarding your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. We may suspend or terminate accounts that violate these Terms.
3. Beta Service
The Service is in beta and is provided for testing and feedback. Features may change or be removed at any time. We do not guarantee uninterrupted access or data availability.
4. Service Description
Encore Live helps users track concerts and view setlist information. The Service relies on third-party providers, including setlist.fm and Supabase. Availability and features may change at any time.
Third-party data availability may change; if access is revoked we may remove affected features/content.
5. User Content
"User Content" includes content you submit or generate in the Service (e.g., comments, collections, ratings, profile info, and uploaded photos).
You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your User Content solely for operating and improving the Service.
You are responsible for your User Content and represent that you have all necessary rights and permissions to submit it.
6. Prohibited Conduct
You agree not to:
- violate any law or regulation;
- harass, abuse, or harm others;
- submit unlawful, defamatory, or infringing content;
- attempt to access accounts, data, or systems without authorization;
- reverse engineer, scrape, or misuse the Service;
- use the Service for commercial purposes without our written consent.
7. Third-Party Services and setlist.fm Data
The Service uses the setlist.fm API and content. setlist.fm content is provided "as is" and we do not guarantee accuracy or availability.
You agree to comply with all third-party terms that apply to your use of the Service, including setlist.fm's terms. If those terms conflict with these Terms, the third-party terms control for their services.
We may change or suspend access to third-party services at any time.
8. Attribution
Wherever setlist.fm data is displayed, the Service provides attribution to setlist.fm with a link to the applicable source or to setlist.fm's homepage, as required by their terms.
9. Privacy
Our Privacy Policy describes how we collect and use information. By using the Service, you agree to our Privacy Policy.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Encore Live will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service.
13. Indemnification
You agree to indemnify and hold Encore Live harmless from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.
14. Governing Law and Jurisdiction
These Terms are governed by applicable law. Any disputes will be resolved in the courts with jurisdiction under applicable law, without regard to conflict of law principles.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice in the Service or by other reasonable means. Continued use of the Service after changes means you accept the updated Terms.
